Turnabout is fair play - GW is being sued.

Post by Primarch » Mon Aug 07, 2017 10:00 pm

Turns out that some people aren't overly happy with GW's methods of stock control. :o
The latest chapter in the house of Games Workshops’ legal troubles is here, as they are being sued for $62.5 million dollars amid 6 criminal complaints.

Game store owner, and legal counsel David Moore has filed a criminal complaint in the US Federal Court of Southern Florida alleging six criminal violations of US law and is seeking $62.5 million in equitable relief from Games Workshop.

Moore alleges violations of the U.S. Law and RICO under 18 & 15 U.S. CODE, including but not limited to Fraud, Price Fixing, Tortious Interference, Breach of Contract, Unjust Enrichment, Restraint of Trade, Conspiracy and Antitrust Violations.
That's quite a lot of complaints. Maybe some of them won't stick, but if even one does, it opens the door for every other FLGS to claim for the same thing. GW may need to break out some new Primaris Lawyers.

Or maybe not. SpikeyBitz has a post up with more details.

Most of the claims are ridiculous and/or the guy making them has no grounds to be doing so. (e.g. claiming GW infringed HR Giger's designs). The comments section of the post has a few guys in it that claim to be lawyers and they all say it's likely to be thrown out of court straight away. :D
I guess it all depends on how amenable the judge is as to how far it gets.

It's completely insane if you read it, though. Like:

Indeed. He'd actually need to prove GW did something illegal instead of whinging about socialist European companies being supplied by China. One claim he did put forward was that GW stiffed him on pre-orders (saying the items were limited) and his customers instead bought from GW direct. (because GW had enough stock to do that). That's buried in amongst a lot of waffle about Starship Troopers and Lord of the Rings though.

just spent ten minutes reading up on this. Jeez. That right there is a load of old toot, and then some. Whoever typed up that document just wasted an hour or so of his life. Unless he was aiming for publicity, in which case, fair enough. But actual legal case? Ridin' that Nope train all the way outta town...

Silly lawsuits is what makes us American. Good luck dude. I'm no lawyer, but I don't see much there. Pretty ridiculous, but so was whacking "Spots the Space Marine" with a cease and desist order.

Forget about yesterday, don't worry about tomorrow because all that matters is today.
